Sync App, Inc. (hereinafter “Syncapp”/”We”) provides this Privacy Policy to inform users of the Syncapp Messenger software application (the “Application”) and the www.syncapp.chat (the “Site”) about our policies and procedures regarding the collection, use and disclosure of Personally Identifiable Information defined below.
  • The Application is intended for people who are competent to contract under applicable law. Individuals who are less than 18 years old are not permitted to use this application unless the complete Agreement is seen and agreed by parents or their legal guardians under applicable law. You confirm that You are at least 18 year old or otherwise competent to contract including with consent of Your parent/legal guardian as may be required under applicable law.
  • This Policy is part of our Terms of Service and applies to the Personally Identifiable Information that is collected in connection with the download, installation and use of the Application and related services. By using the Application or the Site You signify Your assent to this Privacy Policy and consent to the processing of Your Personally Identifiable Information as described herein. If You do not agree with this Policy, or with our Terms of Service, do not download, install and / or use the Application.

Information Collection

“Personally Identifiable Information” means any information that either on its own or when combined with certain other information can identify an individual and for the purpose of this Privacy Policy usually limited to Your mobile phone number, date of birth, gender or address book contact numbers Syncapp may obtain; when we operate and provide our Services, including when you install, access, or use our Services; the following types of information from or concerning You or Your mobile device, which may include personal information that can be used to identify You as specified below:
  • You provide certain Personally Identifiable Information, such as Your mobile phone number, name, gender, location, and date of birth, IP Address and mobile device information to Syncapp when choosing to participate in the use of the Application and its services, such as registering as a user, messaging other users, posting status updates, uploading images or using the other Syncapp features. In order to provide Services, Syncapp, may periodically from time to time, access Your contact list and/or address book on Your mobile device to find collect, use and keep track Your contact list or address book in accordance with this Privacy Policy. By permitting us to collect information regarding Your contacts in Your address book, you hereby agree to provide Syncapp a right to use such information for providing Services and also warrant that you have all requisite rights in your favor to share this information with Syncapp.
  • “Last seen” information is available and displayed to each user whom you have added in your contacts this information is reported to Syncapp when user brings this application to the foreground or quits it.
  • Syncapp may receive data whenever You connect with an application or site through Syncapp (such as during status update, when You connect to other sites and in which case Syncapp posts to these sites on Your behalf). This may include date and time You visit the site, the web address, IP address information, browser and if You are logged into Syncapp and Your authentication tokens used on such sites. Your authentication tokens may be saved on the server for the sole purpose of seamless posting to the same site by You in the future.
  • We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use our Services, how you interact with others using our Services, and the like), log files, and diagnostic, crash, website, and performance logs and reports.
  • If you pay for our Services, we may receive information and confirmations, such as payment receipts, including from app stores or other third parties processing your payment.
  • We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, browser information, IP address, mobile network information including phone number, and device identifiers. We collect device location information if you use our location features, such as when you choose to share your location with your contacts, view locations nearby or those others have shared with you, and the like, and for diagnostics and troubleshooting purposes such as if you are having trouble with our app’s location features.
  • We do not collect addresses or other contact information from users’ mobile address book other than mobile phone numbers, emails and names associated with such mobile phone numbers of the persons in such users’ contact lists and/or address books. The Application will associate whatever name the user has assigned to the mobile telephone number in his/her mobile address book.
  • If the recipient can be messaged via the application, the message is delivered to that recipient via data service routed through our servers. Any messages that are undelivered are held on our servers until they can be delivered or for certain period that improves efficacy of our service. Messages and Files that are sent through the Service temporarily reside on our servers for a short period of time until delivery of such messages or files to the intended recipient is complete. To improve performance and deliver media messages more efficiently, such as when many people are sharing a popular photo or video, we may retain that content on our servers for a longer period of time.
  • Any status update messages and profile image updates posted by you is stored on our servers to facilitate the normal use of the Status Updates feature in the Application. This includes but is not limited to the timestamp and the actual status update message.
  • We may retain date and time stamp information associated with successfully delivered messages and the mobile phone numbers involved in the messages, as well as any other information which Syncapp is legally compelled to collect in accordance with retention policies applicable under the law.
  • We use cookies to operate and provide our Services, including to provide our Services that are web-based, improve your experiences, understand how our Services are being used, and customize our Services. For example, we use cookies to provide links to content inside Syncapp and other web-based services. We may also use cookies to understand which of our FAQs are most popular and to show you relevant content related to our Services. Additionally, we may use cookies to remember your choices, such as your language preferences, and otherwise to customize our Services for you.

Third-Party Information

  • We receive information other people provide us, which may include information about you. For example, when other users you know use our Services, they may provide your phone number from their mobile address book (just as you may provide theirs), or they may send you a message, send messages to groups to which you belong, or call you.
  • We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with companies to distribute our apps, provide our infrastructure, delivery, and other systems, supply map and places information, process payments, help us understand how people use our Services, and market our Services. These providers may provide us information about you in certain circumstances; for example, app stores may provide us reports to help us diagnose and fix service issues.
  • We allow you to use our Services in connection with third-party services. If you use our Services with such third-party services, we may receive information about you from them; for example, if you use the Syncapp share button on a news service to share a news article with your Syncapp contacts, groups, or channels on our Services, or if you choose to access our Services through a mobile carrier’s or device provider’s promotion of our Services. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services.

Use of Information

  • We use all the information we have to help us operate, provide, improve, understand, customize, support, and market our Services.
  • We operate and provide our Services, including providing customer support, and improving, fixing, and customizing our Services. We understand how people use our Services, and analyze and use the information we have to evaluate and improve our Services, research, develop, and test new services and features, and conduct troubleshooting activities. We also use your information to respond to you when you contact us. We use cookies to operate, provide, improve, understand, and customize our Services.
  • We use the information to verify your identity, allow you to use your account on multiple devices and transfer your account to another device, to help you find users that are already Syncapp users, so that you can connect using Syncapp and, subject to prior agreement, to allow other Syncapp users to connect with you, to enable you to sync other applications offered by Syncapp, its affiliates and business partners together with your Account and to share information between the applications you use to respond to requests you may make to use Additional Services; to monitor, detect and deter unauthorized or fraudulent use of, or abuse of, Services; to conduct user surveys; to provide you with information regarding Services and any Additional Services; to measure the effectiveness of advertisements that we place on the Internet or in other media; to notify you of any other important information regarding Services and any Additional Services, if necessary; to identify winners of promotional contests, to send gifts to those winners, and to deliver purchased products and services; to aggregate anonymized statistical data regarding Services and any Additional Services; and to comply with applicable laws or legal obligations.
  • We verify accounts and activity, and promote safety and security on and off our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally.
  • We communicate with you about our Services and features and let you know about our terms and policies and other important updates. We may provide you marketing for our Services and those of our affiliates and business partners.
  • We will allow you and third parties, like businesses, to communicate with each other using Syncapp, such as through order, transaction, and appointment information, delivery and shipping notifications, product and service updates, and marketing.

Information You And We Share

  • You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.
  • Your phone number, profile name and photo, online status and status message, last seen status, and receipts may be available to anyone who uses our Services, although you can configure your Services settings to manage certain information available to other users.
  • Users with whom you communicate may store or reshare your information (including your phone number or messages) with others on and off our Services. You can use your Services settings and the block feature in our Services to manage the users of our Services with whom you communicate and certain information you share.
  • We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. When we share information with third-party providers, we require them to use your information in accordance with our instructions and terms or with express permission from you.
  • When you use third-party services that are integrated with our Services, they may receive information about what you share with them. For example, if you use a data backup service integrated with our Services (such as iCloud or Google Drive), they will receive information about what you share with them. If you interact with a third-party service linked through our Services, you may be providing information directly to such third party. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services.

Manage Your Information

If you would like to manage, change, limit, or delete your information, we allow you to do that through the following tools.
  • You can change your Services settings to manage certain information available to other users. You can manage your contacts, groups, and channels, or use our block feature to manage the users with whom you communicate.
  • You must change your mobile phone number using our in-app change number feature and transfer your account to your new mobile phone number. You can also change your profile name, profile picture, and status message at any time.
  • You may delete your account at any time using our in-app delete my account feature. When you delete your account, your undelivered messages are deleted from our servers as well as any of your other information we no longer need to operate and provide our Services. Be mindful that if you only delete our Services from your device without using our in-app delete my account feature, your information may be stored with us for a longer period. Please remember that when you delete your account, it does not affect the information other users have relating to you, such as their copy of the messages you sent them.

Security of Personal Information

  • We may collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to:
    • respond pursuant to applicable law or regulations, to legal process, or to government requests;
    • enforce our Terms and any other applicable terms and policies, including for investigations of potential violations;
    • detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues;
    • protect the rights, property, and safety of our users, SyncApp Inc, its family of companies, or others.
  • We have implemented commercially reasonable physical, managerial, operational and technical security measures to protect the loss, misuse and alteration and to preserve the security of the Personally Identifiable Information in our care. Our security practices and procedures limit access to personal information on need to know basis only.
  • Such measures may include, where appropriate, the use of firewalls, secure server facilities, implementing proper access rights management systems and processes, careful selection of processors, standard authentication and encryption policies for our servers and other technically and commercially reasonable measures.
  • However, Syncapp cannot guarantee in any way with respect to any Personally Identifiable Information or Contents that You upload transmit, share or display through the Application or the Site and You do so at Your own risk.
  • Using unsecured or other unprotected networks to send messages and use of other features through the Syncapp application is not recommended.
  • If Syncapp learns of a security breach, then we may attempt to notify You electronically so that You can take appropriate protective steps.

Determining and sharing location

We offer several services like voting, surveys and location sharing that require Syncapp to know your current location. We have made the home location setting explicit in the settings tab and unless you set the location we do not know your home location. The location is only used to produce aggregated reports about votes and surveys and not shared directly with other parties. The app also has location sharing between contacts, groups and channels however Syncapp does not look into these messages unless required by law. Please use discretion when using these tools and you do so at your own risk.

Privacy settings

There are several privacy controls build into app to control spread, visibility, editability and life of messages. However these controls can be circumvented, sniffed, reverse-engineered, incorrectly implemented, may not function as imagined or fail all together. Please use discretion when using these tools and you do so at your own risk. We also offer channels which allow mass publication of the content, Syncapp may look inside these messages and retain information and meta-data to offer trending topics, channel recommendations, channel discovery and personalization.

Changes to this Privacy Policy

Any changes in the Privacy Policy by Syncapp shall be posted on our website www.syncapp.chat to reflect changes in our policy so that the users are always aware of what information we collect, use, and under what circumstances, if any, we may disclose it. Users should periodically review this page for the latest information on our privacy practices. Once posted, those changes are effective immediately. Continued access or use of the Application constitutes Your acceptance of the changes and the amended Policy.
